Exploiting a legal loophole, 7 appellate courts have ruled that undocumented immigrants are not entitled to Miranda Rights. The courts ruled that, because ICE uses administrative warrants instead of criminal warrants, immigration-related detainment is considered civil and not criminal, eliminating the need for Miranda Laws. While Circuit Judge Salvador Mendoza ruled in favor of this, he urged the 9th circuit to consider giving constitutional rights to non-citizens in the future.
